Platform Availability

Warmply does not require user account creation. The Service operates entirely on Your device without requiring registration or login credentials. All preferences, reply history, and style data are stored locally on Your device.

AI-Generated Content

Nature of AI Content

The Service uses artificial intelligence to generate reply suggestions. You acknowledge and agree that:

• AI-Generated Content is provided as suggestions only
• You are solely responsible for reviewing, editing, and approving any content before posting
• AI-Generated Content may not always be accurate, appropriate, or suitable for Your intended purpose
• The Company does not guarantee the quality, accuracy, or appropriateness of AI-Generated Content
• AI systems may occasionally produce unexpected or unintended results

Your Responsibility for AI Content

When You use AI-Generated Content, You:

• Accept full responsibility for any content You post to social media platforms
• Agree to review and edit AI-Generated Content before sharing
• Understand that You, not the Company, are the author of content You post
• Accept liability for any consequences resulting from content You share

Content Guidelines

You agree not to use AI-Generated Content to:

• Harass, bully, or threaten others
• Spread misinformation or false information
• Impersonate individuals or organizations
• Violate the terms of service of any social media platform
• Engage in spam or automated posting that violates platform policies
• Create content that is illegal, harmful, or violates others' rights

Voice to Text Feature

Voice Processing

When using the Voice to Text feature:

• Voice recordings are processed locally on Your device when possible
• Temporary audio data is used solely for speech-to-text conversion
• We do not store or transmit Your voice recordings to Our servers
• You are responsible for the content of Your spoken words

Microphone Permission

The Voice to Text feature requires microphone access. By granting this permission, You acknowledge:

• The microphone is used only for the Voice to Text feature
• You have the right to revoke this permission at any time through Your device settings
• Revoking permission will disable the Voice to Text feature

Acceptable Use

You agree to use the Service only for lawful purposes. You agree not to:

• AI Processing: When generating replies, post content may be processed by AI services. No personal identifiers are attached to these requests.
• Your Responsibility: Since data is stored locally, We are not responsible for any data loss resulting from app uninstallation, device failure, or clearing of app data.

Data Loss

You acknowledge that the Company is not responsible for any loss of data resulting from:

• App uninstallation
• Device failure or damage
• Operating system updates
• Clearing of app data or cache
• Device reset or factory reset
• Any circumstances beyond Our control

Limitations of Service

• Local Data Only: Reply history and style data cannot be transferred between devices as all data is stored locally.
• No Cloud Backup: We do not provide cloud save functionality.

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

THE COMPANY DOES NOT WARRANT THAT:

• The Service will be uninterrupted or error-free
• AI-Generated Content will be accurate, appropriate, or suitable for Your purposes
• The Service will be compatible with all devices or social media platforms
• AI services will always be available

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO:

• Loss of data or reply history
• Consequences of content You post to social media
• Social media account restrictions or bans
• Any issues arising from AI-Generated Content
• Loss of reputation or business opportunities
• Device damage or malfunction

Indemnification

You agree to defend, indemnify, and hold harmless the Company, its affiliates, and their respective officers, directors, and employees from any claims, damages, or expenses arising from:

• Your violation of these Terms
• Your use of the Service
• Content You post to social media platforms using the Service
• Your violation of any third-party rights
• Your violation of social media platform terms of service

Termination

Termination by You

You may stop using the Service at any time by uninstalling the Application. Uninstalling will delete all locally stored data.

Termination by Us

We may terminate or suspend Your access immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, Your right to use the Service will cease immediately.

Governing Law

The laws of the Philippines shall govern these Terms and Your use of the Service.

Disputes Resolution

If You have any concern or dispute about the Service, You agree to first try to resolve the dispute informally by contacting the Company.

Severability and Waiver

Severability

If any provision of these Terms is held unenforceable, it will be modified to accomplish its objectives to the greatest extent possible, and the remaining provisions will continue in full force.
